In the five boroughs of New York City — Bronx, Brooklyn, Manhattan, Queens, and Staten Island — residents may need a permit to install a pool at a one- or two-family residential building.
All pools must meet the following four safety requirements:
- If the lot is less than 25 feet wide, the pool must be at least 3 feet from any side yard line.
- If the lot is 25 feet wide or more, the pool must be at least 5 feet from any lot line.
- There must be a 4-foot-high fence completely surrounding all in-ground pools, with a closed, childproof, self-closing gate.
- There should be no overhead electrical conductors within 15 feet of the pool.
In New York City, there is also a NO Penalty and NO Cost Deck or Porch Inspection Program, launched in 2010, which allows homeowners to call 311 and request an inspection of their porch or deck.
By law, homeowners are required to maintain their decks, porches, and properties in a safe and compliant condition at all times. New Yorkers are encouraged to call 311 to report non-compliant conditions or 911 for emergencies.
