JUST FOR YOUR INFO: In the 5 boros (boroughs), New York City area, Bronx, Brooklyn, Manhattan, Queens, & Staten Island residents may need a permit to install a pool at a 1 or 2 family residential building.

Any pool has to meet these four requirements:

  • If the lot is less than 25 feet wide, it must be at least 3 feet from any side yard line.
  • If the lot is 25 feet wide or more, the pool must be at least 5 feet from any lot line.
  • There must be a 4-foot high fence all the way around in-ground pools with a closed, childproof, self-closing gate.
  • There should be no overhead electrical conductors installed within 15 feet of the pool.

In New York City, there is a NO Penalty and NO Cost Deck or Porch Inspection Program that was first launched back in 2010, which allows homeowners to call 311 and request an inspection of their porch or deck.

By law, homeowners are required to maintain their decks, porches and properties in a safe and complaint manner at all times. New Yorkers are encouraged to call 311 to report non-compliant conditions or 911 to report emergencies.
